The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. Carroll is a native of Trinidad and a retired US Navy officer. My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

Hi,
I am a July 2007 filer (EB3 India). In the coming weeks, my employer is opening up senior position in different states and has encouraged existing employees to apply.
If my employer is open to offering me a job for the new position, (and process a EB2 PERM/I-140 for the new position) what would be my option with the existing I-485.
Is it recommended to keep the existing I-485 as is an file a new one? Or should the existing one be updated with the new I-140 (EB2) when that gets approved? How does it affect AC21 portability if existing I-485 is updated.

As I understand , either there would be no bulletin revision(currently appearing impossible) or there would be a bulletin revision making some categories unavailable , in which case it doesnt matter even if your application has made it on July 2nd it will be returned. So why is the rush to get applications by mail/fedex/samedaydelivery/inpersondelivery/etc ?
Or is the rush to deliver only for those applicants with PDs in 2002-2004 who are hoping that their PD will make it in the new bulletin if it is not unavailable? I see no reason for the rush which seems to have increased after the rumor about the new bulletin on friday ...(although I personally asked my lawyer to send it on friday 6/29 and for which I have no confirmation if it was actually sent or not).

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

You can get I-20 etc. But I think you will have to go to home country to get your F1 stamped. But better check with a lawyer.

I held an H1 B Visa from 2005 to 2008. I worked in the US from for 1 year from 2006 to 2007. I had to return to my home country and my visa expired in 2008. I have been out of US for more than a year and now I am on H4 status (not employed currently) and I would like to know the below:
1. Am I eligible to renew my previous H1 visa. Will my visa petition be considered as an extension of my previous H1 B?
2. Will my application fall under the cap exempt or will I be subject to cap limit
3. If the above fail, what other options do I have?
Pls guide.

My wife works for a University on her CPT. The University received a prevailing wage for her for her H-1B from the state agency on December 31, 2009 and it is still valid.
1. So when the University files for the LCA, can they use the prevailing wage from the state agency or do they have to use I-CERT for prevailing wage (ETA Form 9141)? Can the University use any other source for prevailing wage?
2. How long it is taking now to get the LCA certified?

Hi Everyone,
The A# that is listed on my I-485 receipt notice is different from the one listed on my approved I-140. In addition, the number listed on my I-485 receipt notice has only 8 digits instead of 9. From reading various forums, I've heard both sides of the story...some are saying that something like this needs to be corrected, and some others are saying that the A# is just a file number, and eventually gets consolidated.
I called USCIS customer service, but they weren't much help as they couldn't pull up the information in their system.
Any inputs? I'm planning on inquiring about this when I go for fingerprinting. Also curious to know if anyone's A# on their approved I-140 has nine digits, and if the one on the I-485 receipt notice only has 8 digits.

Hi,
We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?

In case my I-140 is denied, will she lose her status and would have to leave the country?
