Hi,
We are going to India on Vacation in Aug 2008. I am on H1B visa and my daughter (3 yrs) is on H4 (My dependent). My wife came to US as my dependent on H4 visa. But now she is on L1B visa.
Q1: Can I add my wife as a co-applicant while booking the appointment online even though she is not my dependant )so that we can all appear for the interview at the same day and time)? I didn't find any guidelines related to this anywhere.
Q2: We are looking for an appointment on Sep first week. Will the slots for Sept available by Aug 1st week? How many days before I can book the appointment?

Hi,
I am working with a consulting company and my company filed for my GC in 2009 (PD is 25-Feb-2009). I received my I-140 approval on 28-Feb-2010. Now the client where I am working, has offered my a fulltime job and GC processing. I have received mutual consent from my current company for any legal issues. Now, if I join the new company and file my GC from there, can I port my Priority date for the new processing? Also, what should be the earliest joining date? What all other precautions should I take while filing GC with the new company?
I received the offer on 07/09 and have to give my decision by 07/15. I would appreciate if anyone can help.

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.
1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.
2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

Restamping is not required. But just make sure you show your new approval notice to IO at POE. Done this couple of years back

Guys, My labor was moved to Dallas Backlog center and got approved in 2006. When I searched its detail in files from flcdatacenter.com, I could not find any labor that matches my ETA number. I am not sure if there is any way to get the details. Though, online status site of Dallas backlog center shows the status but without any usable details. My labor's ETA number starts with D-xxxxx-xxxxx. Does any body has similar ETA number ?

Hi,
I have applied my H1 extension in Sep 2008 and got RFE in Dec. RFE was about my work address and we have sent the details. On March 2 2009 I have received the email saying Denial Notice Sent. Not sure the reason yet. I wanted to check my options. I do have EAD. But not used. What is my visa status now? I am planning to resubmit my application based on the denial notice. If I resubmit will I have status in US? Or should I work on EAD. If I work on EAD what should i do? I mean do I need to file AC21?

I am trying to change my job from PM to technical lead. My labor was filed for computer systems manager. Will technical lead come under the same category & occupation as computer systems manager?. New employer agreed to give me similar job duties in EVL & I am getting 40% hike. Is it wise to use AC-21 here?.

Hi,
My family had visited me way back in 2004 on a visitor visa. Due to unavoidable circumstances, they had to stay beyond the stipulated 6 months ( for 2 more months). We had requested the govt. for extension approval and it had been granted then.
We would like to have them visit us again by Nov of this year. However, when they went for the visa to consulate(last week), it got rejected, because the consulate person informed them that they had overstayed last time around.
I would like to know when can I legally apply for the visa again? And is there a way I could enhance my chances of an approval, rather than a rejection, next time I try. I am working on an EAD and my husband had filed for I485 for our family(I140 approved stage).
Any advise would be appreciated.

I was entered into the United States when I was 8 years old. I was entered on the plane with a fake passport and ever since I've been using my real name. I used my real name for school and college. I'm currently here illegally. I want to start my process of application for citizenship but there is a problem. My lawyer told me to marry under the name i entered with and so i did. Before we started the application he realized i was finger printed under my real name so if i were to apply my finger prints would show already in the system. So the only solution is to change my fake name to my real name (which doesnt have a visa) on the marriage license. How do i go about doing so? and will i still be able to obtain a green card? I reside in massachusetts.
