hi folks,
I need some help wrt my wife's immi status.
She had applied H1 (from H4), and got the approval notice I-797.
Now, we applied I-485 for both of us on July 1st
But our attorney did not file for EAD/AP, because of time constraints.
Is it ok for her to start working using the H1 from Oct 1st?
Will it jeopardize her I485 Appln?
Any info / experience on this will be of great help.

Mine was filed in august 2007. It took 45 days for it to get audited and it has ever since been in process, that is close to 7 months after audit response.

Hi,
I am currently on H4 and had to file my H4 Extension as my current H4 was expiring. At the same time I also filed for H1B in 2008 and was picked up in the lottery. Now I am confused on which application the USCIS will consider.
Will it be H1B or H4?
If my H4 extension is approved after H1B will my status then becomes H4?
if H1B is approved after H4 will then the status becomes H1?
Is there a way that I can make sure the status at the end I have is H1B?

Hello all
My wife dint work for a while on H1 status,but changed back to H4 after working for 6 months with change of status from H1 to H4 at INS..so currently she is on h4..
Will there be an issues during adjustment of status thru at 485 stage..will her details be checked in..?

Hi Gurus,
There was a minor RFE on my wife's I-485 (incomplete form I-1485 - a tick mark was missing) on 18 June. Our lawyer received the RFE and forwarded to us (I am not sure if we also are supposed to receive a copy of the RFE directly from USCIS but we did not). We replied to it and the lawyer sent it to USCIS this week such that it would have been received by USCIS on 1 Jul 09(Wed). I was expecting to see a status change to something like "Response to request for evidence received, and case processing has resumed". However, the case status changed to "Document mailed to applicant".
I am puzzled with this. Does anyone have a similar experience? Any guess what it might be?
Just getting anxious.

Hello Folks,
My H1b is 2 and half years old. I transferred it once, i.e in 2007
My brother has got GC a year ago and started his own company. I am planning to transfer it to him.
I have these following questions.
1. What is the risk on transferring my H1 to a new/small company in this recession period, and the employee strength is just one (my brother).
2. Is it ok to transfer more than one time in short period(i.e in 2 years span)?
3. Also, is it acceptable to stay outside US for couple of months on H1 status with out payroll? Will that be a problem at POE when i return to US?
4) Right now i am out of the project (on bench), so will that be any risk of my H1 transfer getting denied ?
Please help!

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question or suggest any other possibilities for rejection?
